      11. You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

  8. Choices Regarding Ad Targeting and Data Use

    You can simply opt-out of Adfinix’s targeted advertising by clearing browser cache. Please also note that our opt-out mechanism is browser or device specific. Therefore, if you use multiple browsers / devices you will need to perform the opt-out operation for each browser or device. Certain devices and device configurations may prevent our opt-out from operating correctly.

  9. Children's Privacy

    Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.

    If We need to rely on consent as a legal basis for processing Your information and Your country requires consent from a parent, We may require Your parent's consent before We collect and use that information.

    Our Service may contain links to other websites that are not operated by Us. If You click on a third party link, You will be directed to that third party' s site. We strongly advise You to review the Privacy Policy of every site You visit.

Introduction

The following guidelines and policies (“Publisher Policies”) of Adfinix Limited. (“Adfinix”) describe the advertising standards applicable to any person or entity that makes websites, mobile websites, applications, mobile applications or over-the-top platforms, and/or any other digital properties available to Adfinix for monetization via the Adfinix Services (“Publisher”). Any such websites, mobile websites, applications, mobile applications or over-the-top platforms, or other digital properties made available by Publisher to Adfinix shall be referred to herein as the “Publisher Properties”. The Adfinix Services (a) facilitate the delivery and insertion of demand partner advertisements (“Ads”) through the Publisher Properties to end-users and (b) may be composed of web pages available at www.adfinix.com and software, including the Adfinix SDK and the Adfinix Publisher Platform (APX).

In order to use the Adfinix Services, Publisher agrees to abide by these Publisher Policies. Any violation of these Publisher Policies is subject to enforcement as provided below, in Adfinix’s sole discretion.

Adfinix reserves the right to update these Publisher Policies at any time. If an update includes material changes, Adfinix shall provide notice of such update via email. By continuing to use the Adfinix Services subsequent to such notice, Publisher agrees to abide by the updated version of these Publisher Policies.

  1. Prohibited Content

    Publisher is prohibited from using the Adfinix Services if the Publishers Properties feature or promote any of the following content categories:

    1. Graphic or explicit violence (IAB25-2 (Extreme Graphic/Explicit Violence));
    2. Adult, sexual, or obscene content (IAB25-3 (Pornography));
    3. Discriminating, offensive, or profane material or hate content (IAB25-4 (Profane Content), IAB25-5 (Hate Content));
    4. Weapons, weapon accessories, or ammunition (IAB26-1 (Illegal Content));
    5. Illegal drugs or drug paraphernalia (IAB26-1 (Illegal Content));
    6. Tobacco or tobacco accessories (IAB9-9 (Cigars));
    7. Spyware, malware, viruses, illegal hacking, or other materials that are intended to damage or render inoperable software or hardware (IAB26-3 (Spyware/Malware));
    8. P2P file sharing, torrenting, or other content violating or infringing upon any third-party intellectual property rights (IAB26-2 (Warez), IAB26-4 (Copyright Infringement));
    9. Counterfeit goods (IAB26-4 (Copyright Infringement));
    10. Illegal products, activities, or services (IAB26-1 (Illegal Content));
    11. Unmoderated user-generated content (IAB25-1 (Unmoderated UGC));
    12. Websites and other content that are under construction (IAB25-6 (Under Construction));
    13. Incentivized clicks, videos, or downloads (IAB25-7 (Incentivized));
      1. Exception: Publisher may allow rewarded video advertising, provided that the rewards offered to end-users for viewing the Ads are: (a) designated as a rewarded Ad by Publisher, (b) for the app in which the video Ad is displayed, and (c) virtual (i.e., having no monetary value). Publisher shall assume all responsibility and liability for such rewards.
    14. Content offering traffic generation or promoting fraudulent traffic (IAB26-1 (Illegal Content));
    15. Content advocating the superiority of a specific race/ethnic group, national origin, color, religion, sex, sexual orientation, language, status as a veteran, or any other legally protected status (IAB23 (Religion & Spirituality), IAB25-5 (Hate Content));
    16. Uncategorized content (IAB24 (Uncategorized));
    17. Alcohol (IAB8-5 (Cocktails/Beer), IAB8-18 (Wine));
    18. Gambling or online casinos (if there is the ability to cash out in real currency) (IAB9-7 (Card Games));
    19. Lotteries (IAB3-7 (Government));
    20. Pharmaceutical or health products and services, including prescription medications (IAB7-5 (Alternative Medicine));
    21. Abuse support (IAB7-28 (Incest/Abuse Support));
    22. Substance abuse (IAB7-42 (Substance Abuse));
    23. Hunting and shooting (IAB17-18 (Hunting/Shooting));
    24. Virtual private networks (VPNs), proxy servers, or similar services;
    25. Content promoting or containing links that are disparaging to Adfinix or Adfinix’s partners.

    The Publisher Properties must be directly owned, operated, or controlled by Publisher; any exception to the foregoing must be reviewed and approved by Adfinix. Publisher Properties which exist for the sole purpose of gathering Ad impressions are prohibited.

  2. Restricted Content

    The Publishers Properties may be permitted, in Adfinix’s sole discretion, to feature or promote the following restricted content categories, provided that Publisher has appropriate controls to ensure that such content complies with all applicable laws, rules, and regulations of the country and jurisdiction in which the content is served:

    1. Financial services (IAB13-1 (Beginning Investing), IAB13-2 (Credit/Debt & Loans), IAB13-4 (Financial Planning), IAB13-5 (Hedge Fund), IAB13-6 (Insurance), IAB13-7 (Investing), IAB 13-8 (Mutual Funds), IAB13-9 (Options), IAB13-10 (Retirement Planning), IAB 13-11 (Stocks));
    2. Political campaigning (IAB11-4 (Politics)).
  3. Technical Requirements
    1. Application/Adspace Setup

      Applications and adspaces must be set up within APX and adhere to the following requirements:

      1. The combination of application and adspace name must identify the traffic source, placement of the Ad, and the requested banner size (non-cryptic).
      2. The application and adspace details must provide a valid URL that links to the inventory where the Ads are embedded:
        1. In-App: Valid app store link.
          1. Mobile applications must be published in official, industry-recognized app stores. Any exceptions (e.g., third-party app stores, pre-installs, or regional limitations) must be submitted to and approved by the Adfinix Team.
        2. Mobile Web: Valid website domain.
      3. The application type and category must match its content.
      4. Publisher must declare Adfinix as an authorized seller of its advertising inventory in the ads.txt file(s) and/or app-ads.txt file(s) associated with the Publisher Properties, per the official guidance provided by the IAB Technology Laboratory. Adfinix reserves the right to require an update to such files from time to time and Publisher agrees to reasonably comply with any such requests by Adfinix.
    2. Transparency

      The following requirements relate to the information Publisher must send to Adfinix in each Ad request and provide in the setup within APX. In general, each Ad traffic source (i.e., website domain or mobile application) must be split by single website/application in APX. The actual traffic source must match the disclosed traffic source provided within APX or the Ad request. The requirements differ for in-app traffic and mobile web traffic:

      1. In-App Traffic
        1. The bundle/application information must be provided in the App Details’ Download URL within APX. (The bundle must conform to the standard format defined by the relevant app store.)
        2. If applicable, the advertising ID and consent should be sent within the Ad request. Fake advertising IDs will be considered fraudulent.
      2. Mobile Web Traffic
        1. The full URL information of the Ad placement/Ad hosting webpage must be provided
    3. Viewability

      To ensure the authenticity of impressions, Ads must be:

      1. Visible (i.e., not hidden, out of page, stacked, or stuffed); and
      2. Placed reasonably and oriented correctly within the content, including an acceptable number or density of Ads in relation to the content.
    4. Video

      TVideo adspaces must also abide by the additional following requirements:

      1. Video adspaces must be labeled correctly as one of the following types:
        1. Instream: Adspace located within a video player with Ads displayed before, during, or after video content.
        2. Outstream: Adspace located within content.
        3. Interstitial: Full screen adspace located between two pages of content.
        4. Rewarded: User receives a non-monetary reward for viewing a video Ad.
      2. Placed reasonably and oriented correctly within the content, including an acceptable number or density of Ads in relation to the content.
      3. Adspace dimensions must match the inventory type (e.g., full screen interstitial).
      4. Video must be clickable throughout play (except on rewarded adspaces).
      5. On request by Adfinix, a demo and/or test environment of video placements must be provided.
  4. Ad Request Strategy
    1. If Publisher receives a “Currently no ad available” response, the interval between new Ad requests must be at least 10 seconds.
    2. Publishers may only request Ads when Publisher Properties are on screen.
    3. For infinite scroll Publisher Properties, Publisher must insert Ads in soon-to-be visible areas only.
  5. Ad Refresh
    1. Except for sticky Ads, Publisher must not refresh Ads prior to a change in the content of the Publisher Properties.
    2. Publisher may only refresh Ads that are viewable.
    3. Publisher must not allow background traffic (i.e., no Ad refreshes are permitted behind covering elements such as full screen videos).
    4. The refresh rate (i.e., the time an Ad impression is shown prior to replacement) must be at least 30 seconds.
    5. Video Ad placements should not be automatically refreshed.
  6. Ad Positioning and Appearance
    1. Publisher must not:
      1. Excessively advertise, stack Ads, or place Ads next to each other;
      2. Place Ads:
        1. Above the fold for 300 x 250 or larger Ads;
        2. Below the footer of mobile website Publisher Properties; or
        3. In non-interactive areas including, but not limited to, the lock screen and out-of-app spaces;
      3. Place hidden or invisible Ads;
      4. Rescale, format, rotate, or modify Ads; or
      5. Place incentivized Ads, except for rewarded videos as provided in Section 2 above.
  7. Enforcement Policy

    In addition to Adfinix’s rights and remedies under Adfinix’s Terms of Service and/or any other applicable agreements Publisher entered into with Adfinix, any violation of these Publisher Policies may result in the suspension of the Publishers Properties from the Adfinix Services, in Adfinix’s sole discretion. Adfinix further reserves the right to suspend other Publisher Properties on the Adfinix Services, reject future Publisher Properties, or terminate Publisher’s account.

Each party will comply with all laws and regulations applicable to it under this Agreement. Without limiting the foregoing, Buyer will require advertisers and advertising networks to ensure that all ads for which Buyer uses the Service comply with all applicable laws and regulations, will not be misleading, libelous, obscene, invasive of others’ privacy, or hateful (racially or otherwise), will not introduce viruses or other malware to the Adfinix systems or audience members, and will not infringe any third party’s intellectual property or other rights. Adfinix reserves the right to refuse or take down any ads that do not comply with the foregoing sentence. Buyer will not use the Service in a manner that damages the Service. Adfinix and/or Adfinix’s Publishers will not allow advertisers’ ads to appear on a Publisher’s website or application or adjacent to any Publisher content that:

    1. is obscene, defamatory, illegal, deceptive, gambling-related, hateful, violates right of any person or property, or discriminates against individuals based on race, gender, religion ethnicity, or nationality
    2. that contains content promoting illegal activity and incites sentiment
    3. uses materials encouraging or promoting terrorism or violence
    4. uses pornographic material
    5. creates either “Forced visit” traffic or spyware/adware loading pages (including, in either case, popups or popunders) which load ads
    6. creates invisible or nested invisible IFRAMEs loading pages which load ads
    7. uses spyware/adware, load ads invisible, stacks ads or other mechanism that creates fraudulent impressions
    8. reloads/refreshes any code causing multiple impressions to be registered in short succession
    9. otherwise violates the written policies regarding websites and applications as agreed upon by the parties from time to time.

Buyer reserves the right to refuse or disallow any Publishers that do not comply with the foregoing sentence. Adfinix is solely responsible for ensuring that the Publisher’s sites and applications are in compliance with all applicable laws and regulations.
